Real Estate & Property Law

Secure property transactions and effective dispute resolution for buyers, sellers, landlords, tenants, developers and investors, including overseas Pakistanis protecting property at home.

Real estate and property law in Pakistan

Property in Pakistan is transferred under the Transfer of Property Act 1882 and the Registration Act 1908, with land records held by provincial revenue authorities such as the Punjab Land Records Authority and the Sindh Board of Revenue, and by housing authorities and cooperative societies for developed schemes. Fraudulent transfers, defective titles and disputed possession are common, and litigation over land is the largest single category of cases in Pakistani courts.

Mehr And Iqbal protects clients before they buy and represents them when a dispute arises, from our offices in Bahawalpur and Karachi.

Property transactions and title due diligence

Before a client signs, we verify title through the revenue record, registrar's office and the relevant housing authority, check for encumbrances, litigation and pending mutations, and confirm the seller's authority. We draft and register sale agreements, sale deeds, gift deeds, powers of attorney and mortgages, and attend registration so that the transfer is completed correctly the first time.

Rent, tenancy and eviction

Landlord and tenant relationships in Punjab are governed by the Punjab Rented Premises Act 2009 and in Sindh by the Sindh Rented Premises Ordinance 1979. We draft and vet tenancy agreements, pursue and defend eviction and rent-recovery proceedings before the Rent Controllers and Rent Tribunals, and enforce eviction orders. Rent agreement drafting and vetting are also available as fixed-fee fast-track services.

Property litigation and development disputes

We litigate suits for declaration, possession, partition, specific performance and cancellation of documents, challenge fraudulent mutations and forged deeds, and represent developers, contractors and buyers in construction and development disputes, including land acquisition and zoning matters. Our clients include property developers, public and private owners, operators, investors, contractors, suppliers, lenders and real estate investment trusts.

Property services for overseas Pakistanis

Owners abroad are frequent targets of illegal occupation and fraudulent transfer. Through an attested power of attorney we verify and protect title, manage tenancies, recover possession and litigate on the owner's behalf, with reporting by phone and video.
